    hi,

    I applied for a PSW visa in the UK in Jan, my student visa expired on the 31st of jan.my psw application was denied and passport returned on 1st mar 2009. i had the right to appeal until or by the 17th of march. I decided not to appeal because the refusal was due to maintenance funds and I realised I was wrong. I left the UK on the 27th of march, as i had to resign from my job and sort out house contracts.

    I am now back in my country and thinking of reapplying, I have maintained the acct balance and have all other documents, my only fear is the period I overstayed. Will it be an issue?

    It all depends why you were refused a visa. It is not against the rules to be refused a visa. Often it is down to a miss understanding only. I think you should go for it and cross your fingers. Or use Global Visas for the more relaxed approach.

    Hi Gareth,

    I wonder if you can help. I’m a British citizen who has just returned to the UK from Malaysia a couple of weeks ago. While in Malaysia i got married to my Malaysian wife in a ceremony over there.

    We are now looking to process an application for her Visa.

    We are going for a UK Settlement Visa
    She’s a part-2 qualified architect, just in case that has any relevance.

    However, i have returned and need to find employment, hasn’t been a problem before (got degrees etc), so the financial side of the form might not pass as you need 3 months of salary, is that correct?

    Or could my brother (her brother-in-law) be her sponsor?

    We both live in the same big flat and he’s been in employment the last 4 years so has all the necessary documents.

    Is it best to apply with my brother as sponsor or have patience and wait the 6 months or so until i could make a successful application?

    Is it common to reject sponsorships by family members for UK Settlement Visas?

    i booked an appointement with the home office online and they got me an appointement just the day my visas expires, what will happen to me , is it too late ?

    Dear sir
    I’m non EU nationality and had 3 dependents. I am going to apply ILR next month on 5 year WP basis.
    But great concern is that 2007 Jan to May we received child and working tax credit for 5 months, after we discovered we are not entitle to any credit due to ” No Public resources”.
    We stopped these credits and sent letter to HMRC for how to refund it. Then they only sent us overpayment letter so we paid it.
    But what we paid back is less than what we received.
    Now we are filling SET(o) form and “are you receiving any public funds?’
    Don’t know what shall i answer..

    Could you please kindly give me an advice ?

    My advice is relax. Everything will be fine. I would fight your case any day of the week. The law is never meant to be broken BUT mistakes can happen.

    I came to England ‘02 aged 17 on a two year visa to stay with my sister-who’s british by birth and my senior by 11+ years (she’s also my only sibling)About a month before my visa ran out I ran away(could not entertain the thought of leaving the country for any reason) and only just came back to hers recently-last week.In the time I’ve been away I’ve had a son, he’s 3yrs old now though I’m not with his mum-whose also british. Now I’m proper stressed out and desperate to get out of this ‘limbo’.What are the possibilities and options available to me??

    jus to add to the previous message one of the main reasons i didn’t want to return even for a day to reapply or extend it out there was because about 2 or 3 months before I came to stay,we had an encounter with armed men who broke into the house and had guns drawn at my head in my mums presence(im her only son)She suffered a stroke soon after and I was then sent to England to stay with my sister.I was traumatized for many years after and this is the reason I would not set foot in that country.What can I do to become british?pls advice-got plans but i’m been held back for instance I would love the opportnity to further my education

    A single crime does not qualify a person for asylum. Even though that crime was dreadful and should never have happened.

    You must regulate your stay. You have not said if your partner is working and many other facts have not been included. Over all I would suggest you mary your partner or at worst aim for a Common law spouse visa. This will involve going home briefly but I am certain we can bring you back quickly.

    Hi there,

    I have a EU family member 5 yr visa which allows me to work and stay here, as Im married to a Portuguese citizen. We been married since feb 07 and I have my visa since Aug07. Unfortunately my husband cheated on me and now has a child with another women and I want to see will have the right to stay in the country if I apply for a divorce? Im currently working full time and taking a part-time degree in a UK University.

    I spent 12 months out of 14 months in the Uk on a 2 year holiday visa taking a series of short courses. I had no idea one required a sort of study permit for even short courses, some of them lasting only a week.
    I did know however that my maximum time allowed at any time was 6 months and so i made sure i never exceeded 3 months at any given time by travelling out of the UK in between the courses.
    However on one of my return trips i was refused entry by the Uk border agency and subsequently had my visa cancelled and then issued a one year reentry ban before being repatriated to my country voluntarily at my own expense.

    I would just like to know, what my chances are after the ban runs out of ever getting a british visa in the future. I sincerely and truly have no intentions of ever migrating to the UK, otherwise i would not have bothered at great expense trying to stay within the law by travelling back and forth so many times.

    Please give me your honest opinion and advise, any reply would be highly appreciated.

    You may have a right to stay but not based on the relationship. How else could we look to keeping you in the UK?

    My friend is in dilemma at the moment.He came to the country under fiancee visa and was given 6 months to stay. His relationship didn’t work out but he continued to stay in the UK as he thought of leaving after his visa runs out.Eventually he decided to stay but it was too late to sort out his papers as he overstayed already (that’s his thinking). He met his current partner about 5 years ago and she’s applied for EEA2 for him last 2007. His application is now being under consideration provided he submits all documents required. He was able to produce everything except for the NHS card. He did try to apply for this when he still has a valid visa but was rejected as there was only 6 months stay stated on his passport. He was given papers by the Home Office just to say that he can work until they issue their decision in 6 months. It’s been over a year now that he is working and now that his papers are back on track, he wants to know whether he can now apply for the NHS using letter from HO stating he’s applied for the EEA2. Do you know why HO need the NHS card? Is it to know if he is accessing public funds? He has tried to apply for a comprehensive health insurance but they won’t accept him either without GP registration. He was given two weeks deadline to produce an NHS card. Thanks in advance. Your help is very much appreciated.

    I need your advise on how to get a visitors visa for my daughters fiance ( he is Egyptian). Currently my daughter is in Egypt. She and her fiance have started a small business in a hotel. My daughter plans to come back to England in the new year to visit family and attend a wedding of a close family friend. How do we go about applying for visa for her fiance? Do I or does she have make a formal invitation. Any information or tips you could give me would be a great help. many thanks

    I am in aggrieved dont know what to do.I have beenstudying in uk since 2001 and having renewed my visa soundly having done my undergraduate degree and masters degree recently. I decided to apply for tier 1 post study work visa and was declined due to maintainance issue.Dint even know i was meant to maintain £1333 for myself and daughter anyway my application was declined and right of appeal given. Appealed through some solicitors provided statements and cover letters from an account held in a credit union and an account held abroad. Have received the determination which states i submited fake and ungenuine documents and dismissed my appeal Applied for reconsideration which was rejected as no error of law. Now the letter received after application for reconsidration from senior immigration judge contain an error implicating i was meant to show £800 which i did not, he dint even look at the documents supplied in the appeal hearing. Now have made an pplication to high court for reconsideration. Do you think i will succeed bearing in mind that all the information submitted is all genuine and have never even submited fake document ever. Dont even know where to get them from. Please any advice is apprecited and thank you applied

    i’m applying for a fiance visa to the UK. How long after it is issued do I have to travel to the UK? I can’t seem to find that answer online or on the UK Border site. Also do I have to stay in the UK? I was also wondering if I can travel back to the US and come back before or after getting married. Can I enter the UK on the fiance visa a few times during the 6 months it is good for is my second question?

    I have another question. I received my fiance visa already and am trying to book a flight to London. Do I have to have a return ticket even with plans to marry and apply for settlement or will I be ok with a one way ticket?
